Cologne Archdiocese abuse liability litigation

The Higher Regional Court of Cologne has overturned a lower court ruling regarding a sexual abuse case involving the Cologne Archdiocese. The initial decision by the Cologne District Court had dismissed a claim for damages, arguing that the perpetrator, a priest, acted as a “private person” during his “free time” rather than in an official capacity.

The Higher Regional Court indicated this judgment requires correction, noting that the perpetrator exploited his role as a spiritual counselor as a “great cover.” The abuse occurred in the 1970s and 1980s after the priest was granted permission to take the victim into his care as a foster child.

The court has signaled its intention to award between 500,000 and 600,000 euros in damages. If finalized, this would set a record for the highest compensation awarded by a German court to a victim of abuse within the Catholic Church, surpassing the previous maximum of 300,000 euros. The court noted that 360,000 euros previously paid to the plaintiff by the Independent Commission for Recognition Services (UKA) will be credited toward the total. A final verdict is expected on November 26.
