Overview
In Colombia, taxpayers face legal and financial consequences for failing to meet income tax filing deadlines. Under Article 641 of the Tax Statute, late filers are classified as ‘omissible taxpayers’ (contribuyente omiso), incurring a penalty of 5% of the tax due for each month of delay. If no tax is owed, penalties are calculated based on income or assets, with a minimum floor of 10 UVT. While primarily an administrative issue, failure to file can become a criminal matter if specific thresholds are exceeded and intent to defraud is proven.
As the 2025 taxable year progresses, approximately seven million individuals in Colombia are required to file returns based on thresholds related to gross assets, income, or credit card consumption. To mitigate high interest rates and late penalties, the DIAN provides payment facilities for up to five years for those with tax debts.
