Controversy over Sunny Hostin’s Cornell assault case defense

Overview

Sunny Hostin, a co-host of ‘The View’ and former prosecutor, faced backlash following her defense of the Tompkins County District Attorney’s decision not to prosecute a 2024 sexual assault case at Cornell University. Hostin argued that the accuser’s statements regarding voluntary intoxication made meeting the legal threshold for criminal prosecution difficult under New York law.

Controversy intensified when reports surfaced that a transcript of the accuser’s interview with campus police contained explicit allegations of rape and descriptions of being “completely and totally incapacitated.” The District Attorney noted that his office had not received this full transcript and stated that if such information had been provided, the matter would have been explored further.

In subsequent discussions, Hostin maintained that her analysis was approached through a “legal lens rather than an emotional one.” She also revealed that actress Cynthia Erivo contacted her to offer advice on presenting legal analysis following the public reaction to her comments.
