Recent judicial developments in Colombia have resulted in prison sentences for former public officials involved in contract irregularities. In Valledupar, former mayor Luis Fabián Fernández was sentenced to five years and six months in prison. A judge found him responsible for entering into a 36,283 million peso contract for potable water and basic sanitation without meeting legal requirements. Investigations indicated that the project involved planning failures and exceeded the municipality’s debt capacity, creating long-term financial obligations. Separately, Felipe Rodríguez Mariano, a former official of the Fondo Financiero de Proyectos de Desarrollo (Fonade), received a sentence of five years and four months. His conviction relates to a 16.6 billion peso contract for the auditing and supervision of free housing units. Prosecutors established that Rodríguez Mariano used his position on the Proposal Evaluation Committee to assist a specific consortium in correcting rejected offers and influencing committee members to secure the contract award in 2017. Specifically, the investigation revealed that while serving on the committee, Rodríguez Mariano improperly assisted a consortium by identifying errors in their commercial offer and advising them on corrections. Despite the consortium’s proposal being rejected twice in April 2017, he facilitated deadline extensions and influenced other members to favor the bidder, ultimately resulting in the contract for the project involving 4,678 homes across nine departments.
