Croatia real estate brokerage regulation

Overview

Croatia has implemented a new Law on Real Estate Brokerage to increase market transparency, legal certainty, and professional standards. The legislation mandates that all agents pass a professional exam and be listed in the Directory of Agents maintained by the Croatian Chamber of Economy (HGK).

A central component of the law is the requirement that agents can no longer operate independently; they must be employed by a registered intermediary or agency to maintain their status. This framework distinguishes the role of the individual agent from the intermediary, which holds the official license for brokerage activities.

The law also clarifies rules regarding agency commissions and prohibits agencies from making property viewings conditional upon the signing of representation agreements. To assist with the transition, the HGK and the Ministry of Economy have held discussions to inform local intermediaries about the practical application of these new regulations.
