Czech and Slovak marital law and social debates

Discussions regarding marital dynamics and legal frameworks in the Czech Republic and Slovakia have centered on financial transparency and legislative reform.

In the Czech Republic and Slovakia, issues of marital finance and property ownership have been highlighted, including personal accounts of unequal financial control within partnerships and legal clarifications regarding the joint ownership of assets, such as vehicles, acquired during marriage.

Legislative changes in the Czech Republic have since simplified divorce procedures. As of January 1, 2026, courts are no longer required to investigate the specific causes of a marriage breakdown, and the previous six-month separation requirement has been abolished. However, Radim Neubauer, President of the Notary Chamber, noted that a formal petition and court decision are still necessary, meaning a purely administrative ‘divorce by letter’ does not yet exist.

Concurrently, political debate has emerged in the Czech Republic regarding marriage equality. Members of the STAN party are advocating for legislation to allow same-sex marriage and joint adoption, seeking to expand upon the rights granted by the 2025 introduction of ‘partnership’ status.
