Czech Constitutional Court judicial rulings

The Constitutional Court of the Czech Republic has issued several rulings aimed at protecting individual rights within judicial and criminal processes.

In one decision regarding legal guardianship, the Court ruled that judicial authorities cannot act purely formally when appointing guardians for individuals with limited legal capacity. The Court emphasized that while a ward’s consent is not strictly required, their wishes must be considered to ensure effective protection of their interests. This follows a case where a municipality was appointed as a guardian despite explicitly stating it did not wish to perform the role.

In a separate ruling concerning criminal procedure, the Court addressed the duration of measures used to replace pretrial detention, such as travel bans and monetary guarantees. The Court found that these restrictions must only last for the duration strictly necessary to justify their use. It ruled that disproportionately extending a monetary guarantee violates fundamental rights to property and freedom of movement, requiring the High Court in Prague to re-evaluate specific restrictions applied to an individual facing terrorism-related charges.
