Czech Republic refinery margin tax dispute

Overview

The Czech government has approved an extraordinary sectoral tax targeting the refinery industry for 2026 and 2027. The measure sets a tax rate at 50 percent of the increase in gross refining margins compared to 2025 levels, with the Ministry of Finance estimating revenue between 5.5 billion and 9 billion CZK.

ORLEN Unipetrol, the only company affected, has challenged the legality of the tax. CEO Mariusz Wnuk warned that the measure might violate the “principle of legal certainty and the prohibition of retroactivity” because calculations depend on year-end economic results determined after operational decisions are made. The company also cautioned that the tax could hinder investments in modernization and low-emission technologies, potentially impacting fuel supply stability and national energy security.
