Daiichi Sankyo and Fortis Healthcare legal dispute
Overview
The legal dispute involving Fortis Healthcare, its former promoters Malvinder Mohan Singh and Shivinder Mohan Singh, and the Japanese pharmaceutical company Daiichi Sankyo has moved toward a forensic investigation of asset dissipation.
In late August 2026, the Delhi High Court ordered a forensic audit to investigate the alleged dissipation of Fortis Healthcare shares and assets. The audit, conducted by S Ramanand Aiyar & Co., aims to reconstruct transactions involving banks and financial institutions to determine how assets available to satisfy a $4.6 billion arbitration award were reduced. Fortis Healthcare clarified at the time that it was “neither a party to the original dispute nor a judgment debtor” and that the audit would not impose monetary liability on the company.
By late September 2026, the Supreme Court of India allowed the forensic audit to proceed after disposing of a special leave petition filed by Fortis. The Supreme Court noted that previous High Court observations were “tentative and only for the purpose of making out a case for forensic audit” and mandated that the process be conducted independently. Fortis Healthcare maintained its position as a “complete stranger” to the legal dispute between Daiichi Sankyo and the Singh brothers, asserting it had no authority over the promoters' share transfers.
