Detention facility human rights and security concerns

Overview

Human rights monitoring bodies have identified severe issues within detention facilities in Argentina and Brazil. In Argentina, judicial actions in Buenos Aires Province addressed inhuman conditions in several police stations. Following a collective habeas corpus filing, a criminal court ordered that no new detainees be admitted to specific precincts in Berazategui, Quilmes-Ezpeleta, and Florencio Varela due to severe overcrowding, fire hazards, and lack of ventilation. The court mandated the urgent transfer of women currently held in these facilities to penitentiary units or municipal jails.

In Corrientes, the Torture Prevention Committee documented grave structural and sanitary failures at the 1st Women's Police Station, including high humidity, leaks, and the provision of raw or decomposed food. The committee's report, endorsed by the Superior Court of Justice, also noted the death of a 38-year-old woman with severe health issues who reportedly did not receive necessary hospital transfers.

Overcrowding concerns have intensified in several provinces. In Chaco, the National Committee for the Prevention of Torture reported a 66.9% overcrowding rate in police stations. In Entre Ríos, the Penitentiary Service reported a 16 percent overcrowding rate, with some facilities operating nearly 40 percent over capacity. Tierra del Fuego has reported a sustained annual inmate population growth of 20%, prompting calls for new infrastructure and provincial execution laws.

In Brazil, the National Mechanism for the Prevention and Combat of Torture (MNPCT) reported that at least 77% of inmates at the Brasília Federal Penitentiary were using psychotropic medications.

To combat criminal activity coordinated from within prisons, the Argentine National Security Ministry has launched a federal program to detect and block mobile phone signals. This system allows provinces and the City of Buenos Aires to voluntarily join through specific agreements to block specific IMEI, IMSI, and phone line identifiers to prevent inmates from directing extortion and other crimes.
