In Avellino, the TAR Campania ordered a school to provide a support teacher for a student’s entire school hours, challenging the sufficiency of Ministry-allocated teacher contingents. Additionally, the TAR Puglia annulled a decision to deny a student advancement following remedial exams, ruling that schools must consider a student’s complete educational path and emotional fragility rather than focusing solely on individual subject failures. Expanding into higher education, the Italian Council of State issued a landmark ruling regarding university students with severe disabilities. The decision establishes that students with documented medical or caregiving needs who pass admission tests for limited-enrollment courses have the right to transfer to a university closer to their residence, even if this exceeds established enrollment caps.
