The Constitutional Court of the Dominican Republic has issued several rulings aimed at defining the limits of state and municipal authority while enhancing institutional accountability. In one ruling, the Court restricted the power of local governments to impose fines, seize property, or create taxes through municipal ordinances. The Court determined that municipalities cannot use their administrative powers as punitive instruments without express legal authorization, as doing so violates property rights and due process. It ruled that records in the Police Control and Intelligence Registry must lose their classified status and be transferred to the National Police historical archive after 10 years. This follows a habeas data action regarding a 2011 investigation that remained active despite the expiration of the legal timeframe. Additionally, the Court imposed significant fines against state entities, including the National Police, for failing to comply with previous judicial mandates and for withholding investigation documents.
