In late July 2026, the Second Collegiate Court of the National District ordered that the criminal trial against former prosecutor Jean Alain Rodríguez and co‑defendants continue, rejecting a defense request to postpone the hearing. The prosecution highlighted alleged misappropriation of more than RD 6 billion, while the defense argued the case had exceeded the four‑year statutory limit for complex investigations. By early August, the defendant formally petitioned the court to extinguish the criminal action, citing article 150 of the Penal Code. Defense attorneys argued that nearly six years had passed without judicial decisions attributing delays to Rodríguez, contending the state caused postponements through prolonged investigations and technical issues. They noted support from groups such as the World Association of Jurists. On 16 August, the Second Collegiate Tribunal rejected the request to declare the extinction of criminal action. The court ruled that the nearly six-year duration did not constitute an unjustified delay, citing the case’s complexity, which includes a file of nearly 12,000 pages and approximately 99 hearings during the instruction phase. The tribunal noted that legal timeframes were not violated due to active procedural dynamics and extensive defense efforts. Representing the Public Ministry, officials including Wilson Camacho asserted that the defense has employed dilatory tactics, such as numerous appeals and recusations, to stall the proceedings. Rodríguez remains accused of leading a network that allegedly embezzled over 6 billion pesos through fraudulent operations between 2016 and 2020. Following the ruling, the defense team, led by attorney Carlos Balcácer, announced its intention to appeal, appeal the decision to the Court of Appeal, maintaining that the process has exceeded the four-year maximum limit established by procedural law.
