Recent court rulings in the Netherlands have addressed cases involving significant financial compensation for wrongful actions. In one instance, the Hague District Court ordered the Dutch state to pay over 646,000 euros to lawyer Annette Mak. This follows a decade-long wrongful criminal prosecution involving allegations of money laundering and forgery. The 's-Hertogenbosch Court of Appeal upheld her acquittal, ruling that her legal advisory work was not criminal, and awarded damages for lost income, legal costs, and non-material harm. Separately, the Hague Court of Appeal ruled that the travel agency Prijsvrij must pay an employee over 60,000 euros in severance. The court found the dismissal of the employee, who suffered from the chronic disease myasthenia, to be abusive after the company terminated his contract following observations of him running a marathon while on sick leave. The court characterized the dismissal as an ‘unverhältnismäßige Maßnahme’ (disproportionate measure). The ruling noted that the employee, who has myasthenia gravis, had disclosed his training regimen to a company doctor. The court further criticized Prijsvrij for using private investigators to shadow the employee during routine activities, such as grocery shopping, prior to the termination of his contract.
