Dutch soft drink tax fraud investigation
Overview
The Dutch Fiscal Intelligence and Investigation Service (FIOD) is investigating a large-scale tax fraud scheme involving the trade of non-alcoholic beverages. Authorities have arrested four men from Enschede, Hengelo, and Leeuwarden in connection with the case, which has resulted in an estimated €8.5 million loss to the Dutch Tax Administration.
Investigators suspect the operation of “ploffers”—companies that collect VAT from customers but fail to remit it to the authorities. The alleged scheme involved purchasing goods from EU suppliers at a 0% VAT rate via intra-community deliveries and reselling them to a Dutch wholesaler at a 9% VAT rate. While the suspect companies reportedly failed to pay the tax, the wholesaler allegedly claimed the amount as input tax.
In addition to VAT fraud, the FIOD is examining potential fraud regarding consumption tax on soft drinks. Searches were conducted at various residences and business premises in Emmeloord, Haaksbergen, and Hengelo, leading to the seizure of digital data and administrative records. Four additional companies are suspected of involvement in similar activities.
