ECOWAS Court ruling on Commissioner Darma
Overview
The ECOWAS Community Court of Justice ruled that the removal and replacement of Professor Nazifi Abdullahi Darma, the former ECOWAS Commissioner for Internal Services, was unlawful. The court determined that the decision made in October 2025 by former Commission President Dr. Omar Alieu Touray to withdraw Darma’s responsibilities failed to meet legal requirements and did not provide an effective opportunity for Darma to respond to allegations.
The court rejected arguments that Nigeria’s recall of Darma automatically ended his tenure, noting that a Commissioner’s mandate is derived from Community law rather than the nominating Member State. Because Darma was entitled to serve until the expiration of his term in August 2026, the court awarded him $50,000 in general damages and ordered the payment of all outstanding salaries, allowances, and accrued financial entitlements. While the court ordered the ECOWAS Commission to cover legal costs, it did not order reinstatement as his tenure had already expired by the time of the judgment.
