Prisons in England and Wales are facing a critical capacity crisis driven by a record high in offender recalls. HM Chief Inspector of Probation Martin Jones warned that the space intended to be freed by government early release schemes risks being ‘dissipated’ by the high volume of individuals breaching licence conditions. Ministry of Justice data shows that 51,419 offenders were recalled to prison over the past 12 months, a figure that roughly doubles levels seen prior to 2023 emergency release schemes.

As of late July, the prison estate was operating at approximately 97 per cent fullness. Officials cautioned that space could run out entirely by November if early release programmes are abandoned.

A report by the charity Nacro, titled ‘The Rise of Recalls’, further highlighted that the scale of recalls is unsustainable, noting a 136% increase in recalls since 2016/17. The report found that in 2025/26, nine out of every ten prison beds freed by releases were filled by individuals recalled to custody. Nacro chief executive Enver Solomon called for a system overhaul to prevent a ‘revolving door of custody’, arguing that without addressing root causes like homelessness, prison spaces will continue to be occupied by those recalled for minor license violations.
