Overview

The European Union General Court has issued several rulings regarding the designation of major technology services as ‘gatekeepers’ under the Digital Markets Act (DMA).

In July 2026, the court upheld a decision to classify Apple as a digital gatekeeper. The ruling rejected Apple’s attempt to have its marketplaces evaluated separately by hardware, instead determining that the App Store is a “single, unified service” spanning the iPhone, iPad, Apple Watch, Mac, and Apple TV. This ensures DMA regulations apply to the App Store across Apple’s entire ecosystem.

In a separate matter, the court rejected a legal challenge by Opera regarding Microsoft Edge. While Microsoft Edge meets certain user thresholds, the court found the European Commission did not err in excluding the browser from the strictest tier of regulation, agreeing that it does not serve as an essential gateway between businesses and consumers. Although Edge was not designated a gatekeeper, Microsoft remains subject to DMA regulations for other services, including Windows and LinkedIn.
