The European Court of Human Rights (ECtHR) has issued several rulings regarding human rights violations in various European nations. In Greece, the Court ruled that the state violated Article 3 concerning detention conditions for a Syrian national at a Mytilene police station. Regarding Turkey, the Court found violations of Article 5, noting that eight individuals were held in pretrial detention for excessive periods, some exceeding six years, without sufficient justification or consideration of alternative measures. In Spain, the Court condemned the imposition of “disproportionate” prison sentences on four protesters involved in the 2011 siege of the Parliament of Catalonia. While acknowledging potential acts of intimidation, the judges ruled Catalonia, ruling that the severity of the sentences such penalties violated the rights to freedom of expression and assembly, noting assembly. Following these developments, the High Court of Justice of Catalonia (TSJC) applied a partial pardon to former Catalan Parliament President Laura Borràs, commuting her four-year and six-month sentence to two years. This pardon was granted by the Spanish government after findings that such penalties could deter public participation in open debate. the original sentence was excessive. Furthermore, the TSJC has declined to lift preliminary rulings regarding the application of the amnesty law to Josep Maria Jové and Lluís Salvadó. Despite clarifications from the Court of Justice of the European Union (CJEU), the TSJC maintains that certain legal questions must be resolved before amnesty can be applied to these individuals.
