First use of U.S. Alien Terrorist Removal Court

Overview

The U.S. Department of Justice completed the first case in the history of the Alien Terrorist Removal Court (ATRC), a specialized federal tribunal established in 1996 that had remained unused for nearly thirty years.

Through this court, Nazira Haji Zada, a 47-year-old Afghan national and lawful permanent resident living in Fort Worth, Texas, was deported to Afghanistan. Prosecutors alleged that Zada acted as a matriarch who supported an ISIS-inspired plot to carry out a mass shooting during the 2024 Election Day. The plot involved her son, Abdullah Haji Zada, and her son-in-law, Nasir Ahmad Tawhedi, both of whom were arrested after attempting to purchase firearms and ammunition from an undercover FBI employee.

Abdullah Haji Zada was sentenced to 15 years in prison, while Tawhedi pleaded guilty to terrorism-related offenses and awaits sentencing. During the proceedings, Zada conceded her status as an ‘alien terrorist’ and waived her right to appeal the removal order, resulting in a permanent bar from entering the United States.
