Overview

Broward County prosecutors have declined to file charges against Melissa Payne following a fatal shooting during a parking dispute at a North Lauderdale Walmart on June 30. The incident resulted in the death of 62-year-old Bart DiGuglielmo, a retired Army staff sergeant and veteran.

Investigations involving video footage from cellphones and a Tesla showed DiGuglielmo approaching Payne’s vehicle and circling it despite her warnings. Prosecutors noted that DiGuglielmo appeared ‘visibly angry’ and made gestures suggesting he might damage the vehicle. A toxicology report indicated the presence of amphetamines, THC, and an antidepressant in DiGuglielmo’s system at the time of the confrontation.

Authorities determined that Payne’s actions were legally justified under Florida’s ‘Stand Your Ground’ law. Assistant State Attorney Stephen Zaccor stated that Payne had no duty to retreat and that the state could not disprove her claim of reasonable fear of great bodily harm through ‘clear and convincing evidence.’
