Overview

German courts have issued conflicting rulings regarding consumer rights and online automotive transactions. In one instance, the Higher Regional Court in Frankfurt am Main rejected a claim for 122,000 euros in compensation for loss of use after a buyer continued to drive a vehicle with a defective headlight ventilation system. The court ruled that because the driver continued using the car, no demonstrable economic disadvantage occurred.

In contrast, the Kammergericht Berlin ruled in favor of a consumer regarding an electric vehicle purchase. The court found an online purchase agreement invalid because the final order button was labeled simply ‘Order’ rather than explicitly indicating a payment obligation, such as ‘Order with obligation to pay’.
