Overview
Germany is undergoing significant legislative expansions of its domestic security and intelligence capabilities.
In late September 2026, the Bundestag began debating reforms for the Federal Intelligence Service (BND) and the Federal Office for the Protection of the Constitution (BfV). The proposed changes aim to transform these agencies into ‘real intelligence services’ to counter hybrid threats like espionage, cyberattacks, and disinformation. Proposed powers include the ability to destroy the IT infrastructure of state-sponsored hackers and conduct secret entries into premises to install surveillance software.
Concurrently, amendments to the Federal Police Act were passed by the Bundestag and Bundesrat. This legislation expands the authority of the Federal Police to combat extremism, crime, and human smuggling. New tools include real-time biometric facial recognition, AI-driven video analysis for suspicious patterns, and enhanced telecommunications surveillance. The law also permits suspicion-less checks in designated zones and allows for the direct detention of foreign nationals at transport hubs.
Both sets of measures have faced political criticism regarding potential infringements on civil liberties, privacy, and the risk of racial profiling.
