German Federal Court rulings on vehicle insurance
Overview
The German Federal Court of Justice (BGH) has issued rulings clarifying the scope of motor vehicle insurance coverage.
In one decision regarding casco insurance, the court addressed the “workshop risk.” It ruled that insurers are not required to cover objectively unnecessary work, unperformed measures, or inflated material and labor costs. The court determined that coverage for “costs necessary for repair” only encompasses expenses a reasonably prudent person would incur for professional restoration, leaving the risk of inflated repair bills with the policyholder.
In a separate ruling concerning motor vehicle liability insurance, the court decided that insurers are not obligated to cover the cost of a vehicle upgrade following an accident. The case involved a driver who sought reimbursement for the price difference between a destroyed vehicle and a newer, upgraded model. The BGH confirmed that the insurer is only required to cover the value of the original vehicle.
