German intelligence service reform proposals

Overview

German officials and political groups have proposed reforms to expand the legal authorities of the nation's intelligence services, specifically the Federal Intelligence Service (BND) and the Federal Office for the Protection of the Constitution (BfV).

Interior Minister Alexander Dobrindt has advocated for increased defensive capabilities to enable active cyber defense. This would allow agencies to move beyond passive defense to actively disrupt or destroy technical infrastructure, software, and servers used by attackers, even if those assets are located outside of Germany. This proposal aims to address frequent cyberattacks that threaten physical infrastructure.

Further proposals from the Union and SPD political groups seek to grant the BND authority to secretly enter apartments within Germany and the residences of German citizens abroad to execute intelligence operations. Such measures would require explicit orders and review by the Independent Control Council. Additionally, the BfV would be permitted to investigate organized crime structures if there is evidence of support from state or extremist actors. The reforms also include new tools for managing telecommunications data, allowing agencies to instruct providers to temporarily freeze and store traffic data for potential future use.
