German rail competition and Deutsche Bahn monopoly disputes

Private railway operators in Germany have accused the state-owned Deutsche Bahn of maintaining a quasi-monopoly through systematic bias. Critics argue that the lack of separation between infrastructure and transport services leads to the neglect of private lines and unfair competition. One specific instance cited was the insolvency of Städtebahn Sachsen, which attributed its service suspension to Deutsche Bahn’s failure to clear vegetation from tracks.

The dispute has escalated into legal action regarding market access. Deutsche Bahn subsidiary DB InfraGO has sued the Federal Network Agency (Bundesnetzagentur) to contest a mandate requiring the group to reserve at least 25 percent of capacity on heavily used routes for competitors. This regulatory decision follows a complaint from the Italian high-speed provider Italo, which intends to enter the German market by 2028. The legal battle underscores the tension between Deutsche Bahn’s role as a network operator and its position as the dominant long-distance rail provider.
