German renewable energy and land regulation reforms

Overview

Germany is pursuing legislative reforms to manage land use and energy infrastructure. In Lower Saxony, state officials are proposing an agricultural structure law to combat land speculation by allowing authorities to block sales that exceed 35 percent of standard market values. To further support small businesses and new agricultural entrepreneurs, a reform of the land transfer tax is also under consideration.

At the federal level, negotiations regarding the Renewable Energy Sources Act (EEG) include a proposal by Federal Minister for Economic Affairs Katherina Reiche to cap wind energy lease payments at 3.5 percent of annual electricity proceeds starting in 2027. This measure aims to reduce subsidy expenditures and alleviate the federal budget. However, the forest owners' association AGDW has criticized the move, with President Andreas Bitter warning it could jeopardize renewable energy expansion by diminishing rural acceptance. Bitter characterized the proposal as an ‘unnecessary intervention in a functioning market.’

Discussions have expanded to the offshore sector through deliberations on the Offshore Wind Energy Act (WindSeeG). The Die Linke parliamentary group has proposed creating a federal infrastructure company to bring offshore wind construction and operation under public ownership to prevent market concentration. Meanwhile, the Federal Association of Offshore Wind Energy (BWO) has called for a transition to a ‘CfD-only’ auction model to address an investment gap, noting that no successful offshore wind auctions have been completed since June 2025.

Concerns persist regarding the economic viability of offshore projects due to rising construction costs and the withdrawal of major energy companies. Additionally, transmission system operators have released forecasts for 2027 EEG financing, noting that while costs may decrease due to less subsidy-dependent installations, the final outcome remains uncertain.
