German tax authority and social benefit bank statement requests rules
German tax authorities are permitted under Section 90 of the Tax Code (Abgabenordnung) to request bank statements from taxpayers to verify tax-relevant facts. While authorities have the right to request documentation to clarify tax matters, they must adhere to the principle of proportionality and cannot conduct unrestricted investigations into private lives without a specific cause. Pensioners with additional income sources, such as rental income, capital gains, or self-employment, may face higher scrutiny to ensure all reported income is complete and claimed expenses are legitimate. To optimize tax returns, pensioners may deduct various expenses, including professional costs related to receiving a pension, legal costs regarding pension applications, and certain bank account management fees, as well as health and long-term care insurance premiums. Regarding the redaction of information, individuals dealing with the tax office (Finanzamt) are generally permitted to redact irrelevant transactions, provided the specific payment being verified remains clearly identifiable. However, if an entire account is being audited—such as in cases of self-employment—redacting dates, amounts, or purposes may result in tax estimates or further inquiries. Similar requirements exist for social benefit applicants, such as those applying for Bürgergeld. While authorities cannot demand unlimited data, applicants must disclose financial circumstances, typically covering the previous three months. For these claims, all incoming funds—including the amount, origin, and booking text—cannot be redacted, and outgoing payments must remain traceable to ensure the legitimacy of the claim.
