Hershey Reese’s pumpkin packaging lawsuit
Overview
A U.S. District Judge in Florida dismissed a proposed class-action lawsuit against The Hershey Company concerning its Reese’s Peanut Butter Pumpkins. The plaintiffs, Nathan Vidal and Eduardo Granados, alleged the seasonal candy was misleading because the products lacked the carved eyes and mouths shown on the packaging.
Judge Melissa Damian ruled that the plaintiffs lacked legal standing, characterizing their claims as “subjective disappointment” rather than a concrete financial injury. The court noted that the plaintiffs failed to allege the products were defective, worthless, or had lost economic value, observing that the candies maintained a “novel pumpkin shape.”
In its defense, Hershey pointed to a disclaimer on the packaging identifying the depicted designs as a “decorating suggestion.” The court also rejected claims that consumers overpaid for the items, citing discrepancies in the plaintiffs' pricing data. Attorney James Kelly, representing the plaintiffs, indicated intentions to appeal the decision.
