ICBA lawsuit against OCC over crypto bank charters
Overview
The Independent Community Bankers of America (ICBA) has filed a federal lawsuit against the Office of the Comptroller of the Currency (OCC) in the U.S. District Court for the District of Columbia. The trade group alleges that the regulator exceeded its congressional authority under the National Bank Act by allowing cryptocurrency firms to obtain national trust bank charters.
The ICBA argues that these charters provide digital asset companies, such as Coinbase, Ripple, and Circle, a ‘side door’ into the banking system. According to the lawsuit, this allows firms to gain the credibility of a federal license while bypassing essential regulatory requirements imposed on traditional community banks, including capital and liquidity standards, consolidated supervision, Community Reinvestment Act obligations, and FDIC insurance. The legal challenge specifically targets the OCC’s March 2026 chartering rule and its 2021 Interpretive Letter 1176. The ICBA is also seeking to vacate the conditional approval of the digital-asset custodian Protego.
In response to the litigation, the Crypto Council for Innovation (CCI) has defended the OCC’s actions, characterizing the use of national trust charters as a ‘legitimate form of financial innovation.’ The CCI further contends that the lawsuit represents an attempt by established banking interests to ‘stifle competition.’ The dispute follows previous scrutiny from lawmakers, including Senator Elizabeth Warren, regarding the regulatory oversight of crypto-related banking charters.
