The Indian government has modernized its banking legal framework through the Bankers’ Books Evidence Bill, 2026, which replaces the 135-year-old Bankers’ Books Evidence Act of 1891. Key provisions include a two-track certification system for records using manual, digital, or electronic signatures. To ensure security, the Act includes safeguards regarding the authenticity and integrity of records to prevent tampering. It also provides clearer guidelines for courts when summoning bank officials in cases where the bank is not a direct party, requiring a “special cause” to be recorded in writing.

While the primary focus is on banks, the central government retains the authority to extend these provisions to other financial entities, such as insurance companies, pension funds, and Non-Banking Financial Companies (NBFCs), as the economic landscape evolves.
