Indian Supreme Court traffic fine enforcement
Overview
The Supreme Court of India has addressed the significant gap in the recovery of unpaid traffic e-challan fines, which totaled approximately ₹45,000 crore in recent data.
Initially, the Court suggested that States and Union Territories explore administrative links between unpaid fines and essential services, such as electricity bills, to incentivize payment. The Bench also discussed various enforcement measures, including blocking the renewal of vehicle registration, fitness, and driving licenses, as well as blacklisting vehicles on the Parivahan portal.
Following these observations, the Court issued directives for stricter recovery actions. These include conducting random vehicle checks, impounding vehicles with outstanding fines, and implementing digital restrictions such as blocking ownership transfers and denying registration-related services. Updated data presented to the Court indicated that recoverable fines had risen to approximately ₹49,194.05 crore, with roughly ₹26,175.05 crore collected.
