Overview
Legal and social challenges regarding the rights and safety of indigenous communities in Brazil have emerged in different regions.
In Santa Catarina, the Federal Regional Court (TRF4) overturned a ruling that would have forced the Laklãnõ/Xokleng community to leave the area near the José Boiteux Dam. The community had occupied the site since July 2023 after losing homes to floods. While the court blocked the eviction and demolition of dwellings, it required the state to provide technical risk guidance and emergency evacuation plans.
In Alagoas, the Federal Public Ministry and the Federal Public Defender's Office initiated legal action to protect the Luzia community, consisting of Pankararu and Xucuru-Kariri members. Facing threats of eviction, food shortages, and sanitary vulnerability, legal representatives filed a Public Civil Action against the Union and Funai to secure permanent territory for the group following the death of an indigenous infant.
