In Spain, the High Court of Justice of Madrid rejected a widow’s claim for a survivor’s pension. The claimant argued she was a victim of gender violence during her divorce, but the court ruled she failed to prove the abuse coincided with the legal time of separation. While a 2023 social services report noted symptoms compatible with abuse, the court found this insufficient to meet the legislative requirements.
In Argentina, a judge in La Matanza ruled that a man lost his hereditary rights following the death of his wife. Although the couple remained legally married, the court found they had been separated in fact since 1997. The decision was based on evidence of a prolonged separation without intent to reconcile, including the wife’s attempted divorce and neighbor testimony.
