The Inter-American Commission on Human Rights (CIDH) has referred the case of Fernando Albán Salazar to the Inter-American Court of Human Rights. Albán, a 56-year-old opposition leader and founder of the Primero Justicia party, was detained by the Bolivarian Intelligence Service (SEBIN) at Maiquetía airport on October 5, 2018, following his return from the UN General Assembly. While the Venezuelan Attorney General initially claimed Albán committed suicide, the CIDH concluded that the detention was arbitrary and constituted a “short-term forced disappearance.” The Commission determined that Albán was tortured and extrajudicially executed while in state custody. The CIDH further noted that the state failed to investigate the incident properly, characterizing it as part of a broader pattern of persecution and impunity involving at least 18 similar deaths in state custody. In its submission of Case No. 14.267, the Commission also highlighted that criminal proceedings against Albán violated the principle of legality. The Inter-American Court of Human Rights will now assess Venezuela’s international responsibility, determine reparations for Albán’s family, and issue guarantees to prevent such occurrences in the future.
