Authorities in Resistencia, Chaco, are investigating gynecologist Gustavo Osmar Kumiega following multiple formal complaints involving allegations of sexual abuse, harassment, and medical malpractice. Initial reports indicated seven complaints from six patients and one woman regarding incidents in private settings. Allegations included inappropriate sexual comments, the use of expired contraceptives, non-consensual filming during examinations, and improper medical maneuvers during ultrasounds. As the investigation progressed, the number of women coming forward to the justice system increased to at least nine. Testimonies detailed specific instances of misconduct, such as performing ultrasounds without gloves or proper equipment and attempting to convince patients they required unnecessary sedation. The legal proceedings involve multiple prosecutorial teams, and some complainants have provided digital evidence of misconduct, including explicit messages sent via social media. Following these developments, prosecutor Mariana Echarri ordered the arrest of Kumiega. This action followed simultaneous raids conducted at his private office, his home, and his private clinic, FEMEChaco. In addition to the medical malpractice and sexual abuse investigations involving at least seven patients, Kumiega faces an accusation from an ex-partner regarding sexual abuse occurring outside of a medical context. One complainant, Jésica Ramírez, specifically detailed an incident where the doctor allegedly performed an ultrasound without gloves and made inappropriate physical contact. Authorities are currently evaluating whether the various judicial files against the specialist will be unified into a single investigation. Kumiega remains in custody as the legal process continues. It has been noted that he was previously acquitted in April 2023 of charges involving an attempt to terminate a pregnancy without consent and threats against an ex-partner due to insufficient evidence. Currently, the investigation is split between different prosecutor’s offices: one managing the malpractice case that led to his detention, and another processing the seven additional sexual abuse complainants.
