Overview
The legal dispute began when the Calcutta High Court ruled that hotels must obtain separate copyright licenses from the Indian Performing Right Society (IPRS) to provide cable television to guests. The court determined that providing cable TV in rooms constitutes “communication to the public” under the Copyright Act, 1957, meaning a standard cable operator’s license does not cover the commercial use of copyrighted musical and literary works in a hospitality setting.
Following this ruling, the case moved to the Supreme Court of India after Hotel Apollo & Tours Private Limited challenged the injunction. The Supreme Court has since ordered an inquiry into allegations that the hotel failed to disclose a caveat filed by the IPRS and obtained an interim order based on the incorrect claim that its cable operator held a valid IPRS license. The Court has directed the hotel to produce the license in question and noted that serious consequences may follow if the interim order was obtained through incorrect statements.
