Italian court rulings on and INPS pension clawbacks welfare updates
Legal rulings in Italy have begun to limit the ability of the National Social Security Institute (INPS) to reclaim pension and social allowance payments from beneficiaries. In a decision by the Court of Lucca, the institution was ordered to stop seeking the repayment of social allowances from a pensioner and to refund withheld funds. The judge ruled that because the pensioner showed no fraudulent intent and the necessary income data was already available to INPS via electronic certifications, the repayment request was annulled. The court noted that social assistance benefits intended for primary nutritional needs should not be subject to general recovery rules when no fraud is present. Subsequently, the Italian Court of Cassation issued a landmark ruling regarding the ‘Quota 100’ pension scheme. The court determined that INPS cannot reclaim entire annual pension payments from retirees who engage in occasional work. Instead, the court established a principle of income neutrality, requiring that any reduction be proportional to the income earned through work rather than resulting in a total loss of the pension benefit. This ruling also provides protections for beneficiaries of similar measures, such as Quota 102 and Quota 103. Looking toward 2026, INPS has released updated welfare guidelines. Total pension spending for 2025 is projected at 372,450 million euros, a 2.3% increase from the previous year. New provisions include the ‘Bonus Mamme 2026’, which will provide up to 720 euros annually to eligible working mothers, and a Christmas bonus for low-income pensioners of up to 154.94 euros, both scheduled for distribution in December 2026.
