Italian judicial and legal developments

Overview

Recent legal developments in Italy involve rulings from high courts regarding tax law, labor rights, and state power conflicts. The Court of Cassation has issued several significant rulings affecting taxpayers and employees. In ordinance n. 27121/2026, the Court classified ‘ravvedimento operoso’ (voluntary correction of tax errors) as a negotiable choice rather than a mere declaration of knowledge. This requires taxpayers seeking refunds of taxes and interest to prove an essential and recognizable error under Article 1428 of the Civil Code, creating new legal hurdles for recovering overpaid amounts. Furthermore, the Court reaffirmed in ordinance n. 25406/2026 that filing a supplementary tax return is not sufficient on its own to annul a tax assessment or win a legal dispute against the Treasury. The burden of proof remains on the taxpayer to demonstrate that the original filing contained inaccuracies. In labor law, the Court of Cassation has clarified employer responsibilities regarding safety and bonuses. In a ruling concerning workplace injuries, the Court held that an employer remains liable even if a worker exhibits negligence, imprudence, or a lack of skill. The judges noted that the use of obsolete machinery requires a prevention system capable of protecting employees from the consequences of their own potential errors. This follows a legal action by INAIL to recover funds paid out after an accident involving a dropped block of marble. Additionally, regarding performance bonuses, the Court ruled that the absence of specific objectives does not automatically entitle workers to compensation. Under a 2003 union agreement, employees must prove they had a real possibility of achieving targets had they been assigned to qualify for indemnity.
