Italian judicial restrictions on building regularization

Overview

Italian courts have issued rulings that restrict the ability to regularize or expand buildings through various legal mechanisms.

In September 2026, the Italian Constitutional Court ruled that properties regularized through previous building amnesties (condoni edilizi) in 1985, 1994, and 2003 do not achieve full legitimacy. The court determined that the original illegality remains attached to these structures, limiting permissible work to maintenance, restoration, and renovation rather than allowing volumetric bonuses or structural expansions.

Following this, the Italian Court of Cassation clarified the limits of building tolerances under the Salva Casa Decree. The court ruled that these tolerances are intended only for minor discrepancies in projects that already possess valid legal authorization. The ruling established that tolerances cannot serve as a ‘masked amnesty’ for works performed in the total absence of building permits, as there is no regulatory benchmark to measure deviations without a prior legal title.
