Overview
Italian tax regulations and judicial interpretations regarding fiscal residency and foreign asset monitoring have been clarified. Under updated regulations, individuals moving abroad cannot terminate tax obligations solely by canceling local municipal registration. Residency is determined by spending more than 183 days in Italy or by the location of primary personal and family ties. The law distinguishes between tax avoidance and ‘esterovestizione’ (foreign shell residency), the latter of which is classified as tax evasion when a declared residence does not reflect an individual’s actual economic or personal center of interest.
For taxpayers moving to countries with privileged tax regimes, the burden of proof rests on the individual to provide documentary evidence of relocation to avoid sanctions from the Agenzia delle Entrate. A ruling by the Court of Tax Justice of Vicenza (sentenza n. 35/2026) reinforced this by establishing that the obligation to complete the Quadro RW monitoring form for foreign assets is predicated on being a fiscal resident of Italy. If a taxpayer proves they were not a fiscal resident during the tax period, the requirement for monitoring and any associated penalties are invalidated.
