Overview
Kazakhstan is engaged in escalating legal and financial disputes with the North Caspian Operating Consortium (NCOC), the group developing the Kashagan oilfield.
Initially, the Kazakh Justice Ministry threatened criminal prosecution against the NCOC managing director over an unpaid $4.9 billion environmental fine related to sulphur storage breaches. The consortium argued the fine could not be enforced during ongoing arbitration.
The conflict expanded as Kazakhstan filed a confidential arbitration claim alleging $10.7 billion in corruption, bribery, and self-dealing involving 12 contracts from the 2000s. This claim is part of a broader legal effort by the state to seek up to $160 billion in damages, arguing that corruptly awarded contracts and production delays deprived the government of revenue. The NCOC, which includes major firms such as Shell, ExxonMobil, Eni, TotalEnergies, CNPC, and INPEX, has rejected the allegations. The arbitration is being heard at the Permanent Court of Arbitration in The Hague and is expected to continue through at least 2028.
