Kentucky death penalty litigation and implementation

Overview

In Kentucky, the state Supreme Court has denied a petition to end two decades of litigation regarding the implementation of death penalty procedures. The court ruled 6-1 against issuing a Writ of Mandamus that would have required a circuit judge to finalize a lawsuit filed by death row inmates in 2006.

A temporary injunction has halted executions since 2010. Although new regulations were adopted by the Department of Corrections, a judge maintained the injunction in 2025 due to unresolved questions regarding the execution of inmates with intellectual disabilities.

While Attorney General Russell Coleman recently requested that Governor Andy Beshear sign a death warrant for Ralph Baze, the Governor declined. The refusal cited ongoing administrative changes, a lack of necessary execution drugs due to pharmaceutical company refusals, and the Governor’s interpretation that the 2010 injunction remains in effect.
