Kenya mandatory travel health insurance

Overview

In early August 2026, Kenya enacted a mandatory travel health-insurance requirement for all foreign visitors staying up to 12 months. Issued under the Social Health Insurance Act 2023 and its 2024 regulations, the rule obliges travelers to carry at least US$50,000 of coverage. This includes specific minimums for medical treatment (US$20,000), emergency evacuation (US$25,000), repatriation of remains (US$5,000), prescribed medicines (US$300), and mental-health care (US$1,000). Only insurers licensed under Kenya’s Insurance Act may provide the required policies.

The Ministry of Health clarified that travelers can prove compliance through the e-visa system or purchase insurance on arrival. Following the announcement, the Consumers Federation of Kenya (COFEK) lodged a legal challenge in the Milimani High Court, alleging the mandate lacked proper constitutional procedures, could deter tourism, and favored a limited group of insurers.

On August 24, 2026, the High Court in Marsabit issued conservatory orders to temporarily suspend the government directive. This suspension follows a constitutional petition filed by Edow Issack Mohammed and Zhulekha Mohamed Edin, who argue that the Ministry of Health lacks the legal mandate to impose entry conditions, asserting such authority belongs to the Ministry of Interior and the Directorate of Immigration Services. The court is scheduled to hear the matter further on 16 September 2026.
