Kenyan Cabinet gender representation legal dispute
Overview
President William Ruto is facing legal pressure following the expiration of a court-imposed deadline on October 28, 2026, to reconstitute the Kenyan Cabinet. The administration failed to meet the requirement to comply with the two-thirds gender principle mandated by Article 27(8) of the constitution.
A High Court ruling on June 30 declared the previous Cabinet composition unconstitutional, noting it contained only seven women among 25 members, representing approximately 28 per cent. To meet the legal threshold, at least nine women are required. The Court of Appeal has declined to suspend these orders, rejecting a government application to halt the directive while an appeal is pending. The order to reorganize the Cabinet remains in force.
