The Kosovo judicial landscape has seen recent administrative developments and legislative proposals regarding legal jurisdiction. The Kosovo Prosecutorial Council (KPC) approved several annual reports for the Special Prosecution of Kosovo and various basic prosecutions, including those in Peja, Prizren, Mitrovica, and Gjilan. These reports detailed case volumes and procedural shifts, such as a 70 percent increase in mediation in Peja. The KPC also finalized several personnel changes and performance evaluations for state prosecutors. Concurrently, the Democratic Party of Kosovo (PDK) has advanced a legislative initiative to amend the law governing the Kosovo Specialist Chambers in The Hague. Following recent convictions of former Kosovo Liberation Army (UÇK) leaders, which the PDK argues has “criminalized the UÇK and its struggle for independence,” the PDK submitted a bill to the Assembly that seeks to modify sentencing and jurisdictional structures. Key provisions include reducing the maximum prison sentence to 15 years and making convicted individuals eligible for presidential pardons. The proposal further suggests that if the Special Court’s Appeal Chamber orders a retrial, the case could return to Kosovo’s domestic institutions. Additionally, it proposes that appeals against the Appeal Chamber’s decisions could be heard by the Supreme Court of Kosovo. The PDK also aims to introduce international monitoring of the court's operations. While PDK leaders argue these changes are necessary to protect sovereignty, the Vetëvendosje Movement has criticized the move. Legal experts, such as lawyer Besnik Berisha, have warned that the amendments could create “legal uncertainty and jurisdictional paradoxes” regarding the Supreme Court’s oversight of a process outside the domestic system. system, while other analysts suggest such changes may be impossible due to the court's existing legal framework.
