Kosovo war crimes legal proceedings

Overview

Legal proceedings regarding war crimes committed during the 1998-1999 conflict in Kosovo have progressed through indictments and the commencement of trials in absentia.

In September 2026, the Kosovo Special Prosecution Office filed an indictment against 35 former Serbian security officials and commanders for the March 1998 attack on the Jashari family compound in Prekaz. Prosecutors allege the operation was a coordinated action by the Serbian Ministry of Internal Affairs involving heavy artillery and armored vehicles, resulting in the deaths of 26 civilians. High-ranking officials, including Jovica Stanišić and Milorad Ulemek, were identified in the command chain.

Following these developments, the Basic Court in Prishtina began in-absentia trials for other major incidents. One proceeding involves 21 defendants accused of the forced deportation of approximately 862,979 Albanian civilians through property destruction and ethnic-based persecution. While the prosecution alleges these defendants exercised effective control over forces that organized forced columns toward the borders of Albania and Macedonia, a preliminary hearing for these 21 individuals was recently postponed. The interruption occurred because defense attorneys were not provided with case files in a timely manner; court-appointed counsel has since been assigned.

A separate trial was initiated for 53 individuals accused of the Meja massacre and other killings in the Gjakova region, which resulted in the deaths of 370 civilians. The defendants in this case are currently fugitives, and authorities have requested information regarding their whereabouts.
