Legal and administrative developments regarding land use and territory in Mato Grosso involve both agrarian reform and indigenous demarcation. The National Institute for Colonization and Agrarian Reform (Incra) approved a judicial agreement to incorporate 1,746 hectares in Diamantino for agrarian reform. This settlement resolves disputes involving the Betara, Santa Fé, and Rodeio farms, with Incra acquiring the Nossa Senhora da Conceição IV and Santa Clara farms to support family farming. Separately, Regarding indigenous rights, the Sixth Panel of the Federal Regional Court of the 1st Region (TRF1) ruled has unanimously decided to maintain allow the continued demarcation of the Kayabi Indigenous Land, covering approximately 1.1 million hectares across Mato Grosso and Pará. The court rejected landowner requests from landowners in Alta Floresta to suspend the process, which had been supported administrative process. Plaintiffs argued that the demarcation, facilitated by Funai a 2002 Ministry of Justice ordinance, improperly expanded territory and contradicted Supreme Federal Court precedents, asserting they held valid state-issued property titles. However, the court upheld arguments from Funai, the Union, and the Federal Public Ministry despite previous legal challenges regarding (MPF). The MPF maintained that property titles and traditional occupation. titles, even those issued prior to the 1988 Constitution, do not override the original rights of indigenous peoples to traditionally occupied lands. The court noted the current process is a new demarcation intended to cover areas not included in the previously recognized 1982 territory.
