In early June 2026, transgender actress Laverne Cox reported a 90% decline in her speaking-engagement income, attributing the loss to corporate sponsors becoming “very scared” of DEI and “gender-ideology” initiatives. Her account coincided with a Department of Justice opinion declaring the EEOC’s disparate-impact guidelines unconstitutional, arguing that Title VII guarantees equal treatment rather than equal outcomes. The EEOC’s broader shift continued in July. On 6 July 2026, the agency reiterated the rescission of its 1979 interpretive guidance on voluntary affirmative-action plans, stripping employers of a good-faith defense. On 20 July 2026, the EEOC voted 2-1 to eliminate a 1966 rule requiring large employers to submit EEO-1 forms reporting workforce race and gender, a move the chairwoman said violated the 14th Amendment by favoring protected groups. Simultaneously, the EEOC opened an unprecedented investigation into Nike for alleged discrimination against white employees. On 23 July, the EEOC proposed a rule to eliminate the EEO-1 report and five related workforce reports, which would end nearly six decades of mandatory demographic disclosure for large private employers, unions, and government entities. In parallel, the administration withdrew the Uniform Guidelines on Employee Selection Procedures from the Office of Personnel Management, ending federal race-conscious hiring guidance.
