Legal and community disputes have emerged regarding the operations of SpaceXAI and its subsidiaries in the Memphis and Southaven regions. Local residents and the NAACP have initiated legal action and protests against a SpaceXAI data center, citing concerns over air quality, health issues like asthma, and persistent noise from gas turbines. Environmental advocates have further alleged that the facility operates as an unpermitted power plant.

In response to these local tensions, SpaceX has offered discounted Starlink satellite internet service to approximately 2,000 customers in the affected area.

Simultaneously, a broader legal challenge involving xAI and the Trump administration is questioning the constitutionality of ‘citizen suits.’ These provisions, found in laws such as the Clean Air Act, allow private entities to sue for regulatory violations. The Justice Department has moved to dismiss a pollution lawsuit filed by the NAACP against xAI, supporting the argument that enforcement authority should reside exclusively with the president and federal agencies rather than private parties.
